The A83 Trunk Road (Campbeltown) (Temporary Prohibition on Use of Road) Order 2024
The Scottish Ministers give notice that they have made the above Order under sections 2(1) and (2), 4(1) and 16A of the Road Traffic Regulation Act 1984, which will have the effect of temporarily prohibiting use of vehicles on length of the A83 Tarbert – Lochgilphead – Campbeltown Trunk Road from its junction with Burnbank Place, Campbeltown, in a south eastwards direction along Kinloch Road, and around Old Quay Street roundabout, to its junction with Main Street, Campbeltown, a distance of 380 metres or thereby.
The Order, which is required to facilitate the holding of the Campbeltown Remembrance Day Parade 2024 and to enable members of the public to participate in this event, will be in force from 10th November until 11th November 2024. It is anticipated that the prohibition of use of vehicles will be in place for approximately 20 minutes and will only have effect in relation to such part, or parts, of the length of road as is indicated by the appropriate traffic signs.
The Order does not apply to vehicles while being used in an emergency for fire brigade, ambulance, police or coastguard purposes or a vehicle being used for facilitating the holding of the relevant event.

UN Convention on the Rights of the Child (Incorporation) (Scotland) Act 2024 Compatibility Consideration and Narration of Statement of Compatibility
The Scottish Ministers have made the following statement regarding children’s rights.
“In accordance with section 23(2) of the United Nations Convention on the Rights of the Child (Incorporation) (Scotland) Act 2024 (the Act), the Scottish Ministers certify that, in their view, the A83 Trunk Road (Campbeltown) (Temporary Prohibition on Use of Road) Order 2024 is compatible with the UNCRC requirements as defined by section 1(2) of the Act.”

The proposal is an order with the title “The A83 Trunk Road (Campbeltown) (Temporary Prohibition on Use of Road) Order 2024”. This order allows the part of the A83 trunk road described in the schedule of the order to be temporarily closed to vehicles for a period of time on 10th November 2024 when the type of traffic sign specified in the order is displayed. This means that no person may use, or authorise the use of, any vehicle on that specific length of road during that period. The only exceptions are for emergency vehicles and vehicles involved in holding the relevant event. The temporary closure of this part of the A83 is to facilitate the safety of participants and viewers of the Campbeltown Remembrance Day Parade.

- With reference given to the requirements of the UNCRC (Incorporation) (Scotland) Act 2024 (Annex 1, deleted prior to publication), which aspects of the proposal are relevant to children’s rights? (Guidance Section 3.2, pages 20-22).
During the temporary closure of this section of the A83 trunk road there will be no impact on children and young people’s ability to access school and/or childcare facilities, higher or further education institutions, hospitals, places used for recreational activity, and places of worship as this is for a short period of time on a weekend. All local access routes around the closed part of the road will remain open. The temporary closure is to maintain safety for the public parade. Access for all emergency services will be maintained at all times. The only aspect relevant to children and young people both directly and in-directly is the positive impact of protecting public safety by prohibiting vehicular use of this section of the road for a period of approximately 20 minutes. Therefore, it is assessed as positively impacting article 6 rights.
There was the potential for freedom of expression, freedom of association, however these rights are impacted as a result of the event taking place in itself and is therefore outside the scope of this CRWIA. The road closure merely allows for the safe running of the event so this was also ruled out again with article 6 being the only potential impact identified.

Mapping routes show that, while the following facilities have the potential to be impacted because they are close to the stretch of road affected by the order, there will be no issues or restrictions around accessing them as a result of the temporary closure:

None of these facilities are directly accessed from the section of the road that will be temporarily closed under the order. All local access routes will remain open, and pedestrians will still be able to access all venues by foot. Therefore, as a result of this order there will not be any restrictions to the exercise of rights under articles 14, 24, 28 or 31. Local access routes will remain open and the event is well publicised. Further, the temporary closure will last only as long as the short period of time the event will be taking place on the road.
To ensure the safe running of this event, the specified part of the A83 trunk road is expected to be closed for around twenty minutes.
The temporary closure of the road is to facilitate the holding of the event on the road, and enable members of the public to participate in it. As there will be no traffic on the road, the temporary closure will also contribute to the reduction of road traffic incidents during the event. This will have a positive impact on children’s right to life, survival and development.
With UNICEF reporting in their child and adolescent road safety technical guidance that ‘road traffic injuries are the leading cause of death for children and adolescents aged 5–19 years’ we look to reduce chances of this in Scotland by contributing to the improvement of road safety.
Therefore, when reviewing all UNCRC requirements, the only article this order relates to is article 6, which should be positively impacted by the closure of the specified stretch of road.

Mapping evidence showed that no facilities would have reduced access as a result of the closure of the road under this order and allowed us to rule out any impact to articles associated with this, such as articles 14, 24, 28 and 31.
As this is an A road (i.e, a major road), not closing the part specified in the order for the duration of the event was identified to have potentially dangerous consequences and increased risks for the safety of children and young people. Therefore, the mapping evidence allowed us to identify the positive impact closing the road would have on article 6 rights.
