The A68 Trunk Road (Newtown St Boswells) (Redetermination of Means of Exercise of Public Right of Passage) Order 201[ ]

Notice is hereby given that the Scottish Ministers propose to make an Order under sections 2(1) and 152(2) of the Roads (Scotland) Act 1984, redetermining the means of exercise of the public right of passage over the lengths of roads described in the Schedule hereto.

The title of this Order is The A68 Trunk Road (Newtown St Boswells) (Redetermination of Means of Exercise of Public Right of Passage) Order 201[ ].

A copy of the proposed Order and accompanying plan showing the roads over which the means of exercise of the public right of passage is to be redetermined may be examined free of charge during normal business hours from 19 February until 22 March 2019 at the offices of Transport Scotland, 5th Floor Reception, Buchanan House, 58 Port Dundas Road, Glasgow, G4 0HF;  Melrose Library, 18 Market Square, Melrose, TD6 9PN and the offices of Scottish Borders Council Headquarters, Bowden Road, Newtown St Boswells, Melrose, TD6 0SA. 

Any person may object to the making of the Order by notice in writing to The Director of Roads, c/o Scott Danks, Transport Scotland, 4th Floor, Buchanan House, 58 Port Dundas Road, Glasgow, G4 0HF quoting reference SW/A68/SD by 22 March 2019.  Objections should state the title of the Order, the name and address of the objector, the matters to which they relate and the grounds on which they are made.

Footway over which means of exercise of Public Right of Passage is to be redetermined

  1. That length of footway on the east side of the A68 Edinburgh – Carter Bar Trunk Road and on the north side of the D24 road from a point (marked “A” on the plan) 18 metres or thereby northeast of the  centreline of the junction of the D24 road and the A68 Edinburgh – Carter Bar Trunk Road, to a point (marked “B” on the plan) 30 metres or thereby northwest of the  centreline  of the junction of the D24 road and the A68 Edinburgh – Carter Bar Trunk Road, a total distance of 38 metres of thereby, as shown by the sawtooth hatching between points “A” and “B” on the plan.
  2. That length of footway on the central reservation of the A68 Edinburgh – Carter Bar Trunk Road, from a point (marked “C” on the plan) 30 metres or thereby northwest of the  centreline  of the junction of the D24 road and the A68 Edinburgh – Carter Bar Trunk Road, to a point (marked “D” on the plan) 41 metres or thereby southeast of the centreline of the junction of the A68 Edinburgh – Carter Bar Trunk Road and the B6398, a distance of 14 metres or thereby, as shown by the sawtooth hatching between points “C” and “D” on the plan.
  3. That length of footway on the west side of the A68 Edinburgh – Carter Bar Trunk Road from a point (marked “E” on the plan) 41 metres or thereby southeast of the centreline of the junction of the A68 Edinburgh – Carter Bar Trunk Road and the B6398, to a point (marked “F” on the plan) 17 metres or thereby southwest of the centreline  of the junction of the A68 Edinburgh – Carter Bar Trunk Road and the B6398, a distance of 42 metres or thereby, as shown by the sawtooth hatching between points “E” and “F” on the plan.

Statement of Reasons

The Scottish Ministers propose to redetermine the footpath so that they may be used by cyclists and pedestrians only. In the interests of road safety it is desirable to provide safe routes for cyclists and pedestrians.
