Scottish Ministers’ Reporting Duties

The following information is reported as a requirement of section 12 of the Act. The following information should be read in conjunction with the Schedule to the Act.

1. Schedule, Part 2, paragraph 3 (a):

details of the action that each local authority took in fulfilment of its duty under section 1

Local authorities reported the following information under paragraph 3 (a) in respect of the reporting period:

Aberdeen City Council

  • Aberdeen City Council continues to process applications for disabled persons’ parking places where criteria are met. Advisory disabled persons’ parking places are provided until the statutory process is completed. Aberdeen City Council also removes any disabled persons’ parking place that is no longer required.
  • Blue Badge holders, when requesting a disabled parking facility are fully advised of the regulations, that they are open to any Blue Badge holder and that the badge requires to be displayed at all time.
  • Aberdeen City Council enforces all disabled persons’ parking places governed by a Traffic Regulation Order (TRO) and has officers in place to investigate fraudulent use of Blue Badges.
  • Aberdeen City Council has information regarding Blue Badge spaces on their website.

Aberdeenshire Council

Aberdeenshire Council promotes the proper use of parking spaces for disabled persons’ vehicles by routinely issuing excess charge notices to those using such spaces improperly in car parks covered by the Aberdeenshire Council (Off-Street Parking) orders. The number of such notices issued during the reporting period (2021-22) was 147 of which 61 were subsequently cancelled following successful appeals and 8 are currently outstanding having not been paid.

Angus Council

Angus Council are continuing to process applications for new street disabled bays where criteria are met. Advisory bays are provided until the statutory process is completed. Disabled person parking places which are no longer required are removed.

Argyll and Bute Council

Argyll and Bute Council area is split into 4 sub areas:

  • Bute and Cowal
  • Helensburgh and Lomond
  • Mid Argyll, Kintyre and the Islands
  • Oban, Lorn and the Islands

Disabled Bay Traffic Regulation Orders were progressed for each sub area. Disabled bays are enforced by the DPE enforcement team.

City of Edinburgh Council

Staff within Parking Development provide advice and the relevant application form to customers who wish to apply for a DPPP outside their home.

For new developments there are procedures in place to make the developer aware of the duty of local authorities to promote the proper use of parking places that are designated for use only by disabled persons’ vehicles. As part of the planning process the developer is asked if they wish CEC to enforce disabled persons’ parking places.

Clackmannanshire Council

Due to staffing numbers in various departments, COVID and home working applications and traffic regulation orders are taking longer to process.

Comhairle nan Eilean Siar

The most recent TRO was completed in 2018.  This has not been updated during this period.  Applications are being received and assessed with existing bays being maintained.  

Dumfries and Galloway Council

The Council is processing applications as and when received.

A review of TTROs is carried out periodically.

Dundee City Council

Information is available on the DCC website relating to the scheme, rights and responsibilities of Blue Badge holders. Press publications have also been released informing motorists of the increased budget made available to meet standards and maintain existing disabled spaces.

East Ayrshire Council

The East Ayrshire Council (Various roads within East Ayrshire) (Disabled Person’s Designated Parking Places)(Revocation) Order 2022 was made on 18/01/22.

East Dunbartonshire Council

East Dunbartonshire Council continue to promote the proper use of parking places designated for the leaving of a vehicle displaying Blue Badges as require through the Disabled Persons’ Parking Places (Scotland) Act 2009. During the reporting period, a total of 2 Penalty Charge Notices (PCNs) were issued for the offence of being parked in a designated disabled parking bay without a valid Blue Badge.  

East Lothian Council

Advertising literature “Don’t park in my space” has been displayed in all Council offices.

East Renfrewshire Council

Records of locations of all enforceable disabled bays continue to be updated and maintained.

Falkirk Council

Falkirk Council considered all requests for disabled persons parking places by qualifying persons and has where possible commenced the statutory process to make Orders for those applicants.

Fife Council

No promotion carried out.

Glasgow City Council

The Council continued to receive and grant applications for the provision and repaint of disabled parking bays by qualifying persons.

All new developments have been checked and where necessary developers will be contacted and invited to participate.

Highland Council

The Highland Council are currently introducing new townships to decriminalised parking enforcement and with this the parking enforcement team are recognising more disabled parking spaces throughout the Highland area. Parking enforcement are installing disabled bays when area roads do not have the resources or the funding.

Inverclyde Council

Inverclyde Council promotes the creation of parking places for disabled persons through an on-line application process on the Council’s website.

With the introduction of Decriminalised Parking Enforcement throughout Inverclyde, Orders were created to regulate Off-Street car parks and include Disabled Persons’ Parking Places.  The consultation and publicity processes served to highlight the provision of Disabled Persons’ Parking Places within the car parks.

Midlothian Council

All off-street bays for which Midlothian Council is responsible have been identified, assessed and made enforceable by inclusion in a TRO.

New applications are processed as quickly as resources permit. The Council is pro-active in contacting the 'owners' of parking bays periodically to ensure that the bays are still in use, and removes bays which are no longer necessary.

Moray Council

Following the process undertaken previously, to identify all historic advisory disabled parking spaces, the council have been assessing all new applications over the most recent reporting period (1/4/2021 to 31/3/2022) in accordance with the Act and supporting advice. The Traffic and the Blue Badge Teams continue to provide ad hoc advice on the use of Blue Badge Spaces.

North Ayrshire Council

North Ayrshire Council provides disabled parking places to residents within the area where possible.  We also promote Traffic Regulation Orders to ensure these bays are enforceable.

We actively work with local Housing Associations to ensure that any bays they provide are also included within these Orders. 

North Lanarkshire Council

North Lanarkshire Council has continued to assess requests for disabled persons’ parking places and promoted a number of Traffic Regulation Orders to allow the use of parking spaces to be enforced by the Council’s parking attendants.

Advisory markings have been placed at requested locations initially and will remain in place until procedures to promote Traffic Regulation Orders are complete.

Orkney Islands Council

The Council continues to identify both on-street and off-street parking places when applications are received.

Perth and Kinross Council

Parking Attendants regularly inspect and enforce the bays to ensure the proper use of the parking places for disabled persons’ vehicles.

Renfrewshire Council

Renfrewshire Council has made its 6th Disabled Persons’ parking Place On-Street Order which came into operation on the 16 November 2020.

Work on the Councils 7th DPPP Order for the Council which comprises 94 additional new bays. has been held up due to staff requiring to work on Covid related accommodation works in the past year. 

Scottish Borders Council

We have not actively promoted proper use of disabled persons parking places.  If we receive a complaint regarding the use of a bay we will follow this up in writing.

Shetland Islands Council

The Council provides information through various sources in order to reach as many in the community as possible.

The Council web page highlights eligibility, the statutory process and application forms with all relevant information.

Local weekly newspaper (The Shetland Times) to highlight all stages of the statutory process.

All new developments are encouraged to participate in the provision of disabled parking bay(s).

South Ayrshire Council

We are in the process of progressing TROs to update the current position with respect to disabled bays in SAC – orders shall require approval by the Council’s Regulatory Panel following the set statutory traffic regulation order process.

This shall include a review of a number of historic bays to ascertain if they are still required.

South Lanarkshire Council

SLC enforces the regulated disabled persons’ parking bays in line with its policies and procedures.

Stirling Council

Stirling Council continues to assess all applications received for a disabled person’s parking space under the Council’s current criteria which was amended following the introduction of the Disabled Person’s Parking Places (Scotland) Act 2009 within 15 working days whenever possible.

Where the applicant meets the criteria for a disabled person’s parking space outside their property, they aim to arrange for the marking of an advisory space within 10 working days of receiving their agreement on its location.

Once the TRO process has been completed, they arrange for the necessary signage to be erected.

On completion of the TRO the applicant’s details are entered into a database to ensure a complete record is maintained.

Stirling Councils Traffic Regulation Orders and parking policy continue to allow vehicles displaying a Blue Badge to park free of charge and without time limit within any “on-street” or “off-Street” pay and display parking area, in addition to any designated disabled parking spaces.

11 disabled persons’ parking spaces were revoked as they were no longer required.

West Dunbartonshire Council

West Dunbartonshire has an up-to-date database for all on-street disabled parking bays; this identifies those already legally enforceable and those which are currently advisory only.  This is constantly updated to include all new on-street parking bays. Each time a new TRO amendment order is implemented, the bays marked as advisory are automatically included in this schedule.

West Lothian Council

West Lothian Council has provided information through various sources in order to reach as much of the community as possible.  The following methods have been used to convey information:

Information on the council web page at all times.

The back doors of council vans have been vinyl wrapped with a message promoting the correct use of disabled parking places.

2. Schedule, Part 2, paragraph 3 (b)

The total number of parking places designated by the local authorities as being for use only by a disabled persons’ vehicle by virtue of the provisions of this Act (except section 9)

Table 1 below sets out the total number of parking places (excluding temporary places) designated by individual local authorities as being for use only by a disabled person’s vehicle, as reported. The table reports only new disabled parking places made enforceable by an order in the reporting year 2021/22 and does not take account of those removed.

Aberdeen City

Applicant has access to a private, off-street parking facility. Applicant mistook form for blue badge application. Applicant does not live in Aberdeen or moved away from Aberdeen before application was fully processed. No valid blue badge number provided. No proof provided of vehicle registered to applicant’s address. Bay requested to be installed on an un-adopted, privately maintained road, and yet to receive application from the landowner for a TRO to be established. Existing waiting restrictions on applicant’s street of residence mean a bay cannot be established, and applicant directed to existing bay in next street.

Angus

29 requests were refused as follows: 17 – applicant did not return any documents for the request, 3 – moved house, 3 – No V5 at address, 1 – passed away, 4 – withdrew application, 1 – not on council owned land.

Argyll and Bute

Three applications were refused as the applicants had suitable off-street parking within their curtilage.

City of Edinburgh

Applicant has a driveway/garage (7). There are enough available parking spaces near applicant’s address (5). Street under parking regulation review (2). Applicant provided with an exempt residential parking permit to park near home (2).

Clackmannanshire

Clackmannanshire Council’s reasons for decisions where it was determined that it did not have the power to make a disabled street parking order under section 5 – private land, no parking issues on street, applicant passed away after submitting application

Comhairle nan Eilean Siar

Three bays were ‘on street’ in suitable locations where there was no existing provision. One parking place requested was ‘on street’ in the town centre where there was existing provision nearby. The final request was from an applicant, within a housing scheme, who already had an existing driveway.

Dumfries and Galloway

Has an existing driveway/garage. No vehicle registered at address. Applicants request is for a bay on private road – no landowner approval.

East Ayrshire

Applicant had sufficient garden ground to form driveway (20). Applicant required bay in area maintained by Housing Services (1). Applicant didn’t have valid V5c document (1). Applicant was not the driver (5). Applicant had a driveway (2).

East Dunbartonshire

7 Refused Applications. Refusals reasons were: 2 had driveways, 2 withdrawn Applications, 1 Temporary blue badges, 1 Off-road parking, 1 Private parking space.

Fife

Applicant withdrew application. Applicant had no vehicle or had alternative parking on driveway or garage. Bay was denied by land owner. Awaiting proof of vehicle registration to household address.

Glasgow

1 application rejected due to existing traffic regulations prohibiting waiting. 0 applications rejected to maintain access to premises. 9 applications refused due to alternative parking places available to qualifying persons.

Highland

1 refused due to restricted space in turning head whereby if a disabled bay was marked it would cause a disruption to other traffic. 1 refused as customer had a driveway sufficient enough for parking.

Midlothian

4 applications were refused: 1 had no car registered at the address; 3 had a driveway available; 9 applications were withdrawn or suspended by the applicant.

North Ayrshire

2 no suitable location could be found. 2 had Driveway / off-road parking available. 3 were in private areas. 1 already had a bay available.

North Lanarkshire

Road safety issues. Alternative off-street parking opportunities available. Area where bay located out with control of the Council.

Scottish Borders

  • 6 x private land
  • 3 x driveways
  • 7 x no suitable location
  • 1 x bay close by they could utilise

Shetland Islands

The person applying for the disabled bay withdrew their application.

South Ayrshire

Applicant had sufficient garden ground to form driveway (7). Applicant required bay in area maintained by Housing Services (1). Applicant failed to provide valid v5c at correct address (1).

Aberdeenshire

Under section 32(1) of the 1984 Act, the powers of a local authority to provide suitable parking places for vehicles apply where this appears to be necessary for the purpose of relieving or preventing congestion of traffic. Bringing the parking places under the control of the Council and making them subject to an order is not necessary for this purpose in the case of any of the spaces identified under section 7(1).

City of Edinburgh

0 – no expression of interest in CEC enforcing of-street disabled persons’ parking bays received from developers.

Comhairle nan Eilean Siar

No expression of interest from the developers.

Dundee

Unknown.

Highland

No request has been made to developers to see if they wish to formalise bays as yet. The Highland Council are initially concentrating on bringing Highland council on and off-street orders into the TRO and will focus on private land once this is completed.

Inverclyde

No further action.

Renfrewshire

The granting of planning consent is no guarantee of the development going ahead. Developers are allowed 3 years to begin a development and its completion may be delayed any number of years thereafter. It is impractical for council officers to monitor all planning consents for the practical implementation of disabled bays. This said, no off street DPPP provision has been included in any Planning Applications received in the last 2 reporting years.

Shetland Islands

Developer or landowner are not interested.

Stirling

The developers / landowners have not yet been contacted – this is purely because the Council do not have the resources to progress this matter.

West Dunbartonshire

No interest from developers.

West Lothian

The council has the power to make a disabled off-street order if it so chooses.

Developers did not want their disabled parking places to be managed by the Council.

All land involved is private and owners does not wish the council to make a legal traffic order.

Land not in Council ownership and private landlord declined to participate in the process.

West Lothian

The Council has not had any complaints that there are insufficient spaces available or there is constant misuse of the spaces that are provided.

Falkirk

Section 8 of the 2009 Act requires local authorities to determine the locations of advisory disabled persons’ parking bays in off-street car parks biennially. Falkirk Council undertook this exercise in June 2022.

Glasgow

Duties under this section were not enacted during this period.

Highland

Private housing authorities, retail outlets and other private land owners. Will be approached in the near future to discuss enforcement of their disabled bays.

North Lanarkshire

None although subject to consultation with any private car park operator.

Orkney Islands

No arrangement under Section 33(4).

Renfrewshire

Renfrewshire Council publishes a notice in the press every 2 years seeking requests for the inclusion of disabled bays in a traffic regulation order from the owners of private car parks. Renfrewshire Council  routinely receives no responses to this notice. The last notice was published on 30/06/21 and the next is due to be published in late June 2023.

South Ayrshire

No work undertaken due to resources issues.

Stirling

As indicated earlier in this report, no action has been taken at this stage in respect of TROs for advisory off-street disabled persons’ parking places.

Certain streets not included due to objections and disagreements. These streets were removed from the TRO until such time the restrictions are agreed.

There were 3 Orders which started the statutory procedure and was not able to be completed by the end of the reporting period.

Midlothian

None. The only cases where approved sites are not yet included in a Made Order are those which were still being processed at year end.

Shetland Islands

Stirling

An objection was made to the location of the disabled persons parking space (2020(21)), this was missed and time-barred during Covid, the space has been re-advertised as (2022(9)).

One applicant passed away before the TRO could be signed.

One applicant converted their garden.

6. Schedule, Part 1, paragraph 2

A report prepared by a local authority under section 11(1)(a) may contain any other information about its performance of its functions in relation to parking places for disabled persons' vehicles during the reporting period that the authority considers appropriate.

Whilst some local authorities did not report any additional information by reference to Part 1, paragraph 2 to the Act, those who did reported a range of information including clarifications on what activity took place in performing its duties under the Act or what activities are planned for the next reporting year.

19 out of the 32 local authorities did not report any ‘other information’ under this paragraph. Those local authorities are:

The following information has been provided by the local authorities mentioned below:

Argyll and Bute Council

The Council has increased resource within the traffic regulation team which has allowed the progression of four TRO amendments. The increased resource should allow the Council to progress amendments a least once per year going forward.

Clackmannanshire Council

Clackmannanshire Council are a small local authority where we do not have parking enforcement. We are still processing TRO’s due to staffing levels and workloads, these are taking time. Our whole area has been surveyed however the outcome has been delayed by COVID-19.
Budget wise we only put plates up where a blue badge space is getting mis-used or in busy areas, we do not have the funds to do every bay. Although applications have been approved lining works are taking longer than normal due to working with a new contractor.

Dumfries and Galloway Council

Dumfries & Galloway Council are currently undergoing a Parking Strategy Review. The requirements of the DPPP 2009 Act are included in this strategy.

East Dunbartonshire Council

The reporting period is covered by the Covid-19 pandemic and for most of the year activity was reduced.  The Council has not been able to paint road markings or advertise orders on street.

East Renfrewshire Council

The HSCP following their assessment and subsequent approval of the applications from qualifying applicants. However, although arrangements have been put in place to have the bays markings installed on the roads close to the applicants properties, due to existing workload priorities and commitments it has not been possible to make the obligatory Traffic Order(s) necessary to make these bays enforceable as yet.

Fife Council

In Fife we have one TRO with all the enforceable bays listed in it. Each TRO amendment adds new bays and removes bays which have since become redundant. It is hoped that the 17th amendment will be made before the end of 2022.

Highland Council

The Highland Council continue to introduce Decriminalised parking enforcement throughout the Highland area. In order to regulate disabled bays in existing areas The Highland Council have adjusted bay sizes and erected signs to keep things in line with the Traffic signs regulations and General Directions (TSRGD). EV bays are also being installed with disabled users in mind allowing more room for disabled access. Parking enforcement officers have been more involved in the installation of disabled bays. This helps alleviate the workload from area offices and means the bays are installed to enforceable standards.

Inverclyde Council

14 disabled parking places started the statutory procedure before the start of the reporting period and were revoked within the period. 9 disabled parking places started the statutory procedure and were revoked within the period. 80 disabled parking places started the statutory procedure to be revoked. There are 396 current disabled parking places which have been created by means of an Order since April 1996. This is in addition to the 52 created during this reporting period.

Midlothian Council

See Appendix E. 

North Ayrshire Council

North Ayrshire Council continue to carry out its duties under The Act.

Renfrewshire Council

Renfrewshire Council continues to carry out its duties under the Disabled Person’s Parking Places (Scotland) Act 2009 as indicated above.

Shetland Islands Council

Parking has been an issue for some time now and seems to be getting more severe. With this in mind we make it a priority to contact the applicant immediately to clarify qualification requirements are met, identify a suitable space, explain the process and then implement it.

Stirling Council

To continue to liaise with Stirling Area Access Panel with regards disabled parking provision, whether that be new spaces or improvements to existing spaces on or off street. Progress with respect of taking forward disabled parking spaces implement and future enforcement within private car parks needs further analysis, and is still to be carried out, which is dependent on staff resources. Due to the Covid-19 pandemic and restrictions in working from home, it was felt it was not an appropriate time to carry out a review of the existing disabled parking spaces, it is hoped this can be carried out when staff are able to return to the office.

The Scottish Ministers have no other information to report, on the performance of local authorities of their functions in relation to parking places for disabled persons’ parking places within the reporting year.
